DWI - Driving While Intoxicated

Many people who have been arrested for drinking and driving (DWI – driving while intoxicated) are unsure about the legal system. They have never been in trouble before, and they are worried about the permanent impact a conviction can have on their lives.

At the Law Office of Thomas V. Sassone, P.C., we can guide you through the legal system, protect your rights and your license. To do so, we take an in-depth look at the facts and laws that affect your DWI case.

In New York State the legal limit for intoxication to .08%. Stiff penalties may be imposed for DWI conviction including jail time. You may have your driving privileges suspended before you are even convicted. If you refuse to submit to a chemical breath/blood test your driving privileges will be revoked by the NYS Department of Motor Vehicles regardless of whether you are convicted or not.

If you are convicted for a DWI offense your driving privileges will be suspended or revoked for a period of time, among other fines and penalties which will be imposed. You may even have to install an ignition interlock device on every car you own.

That is why handling a DWI the right way is no laughing matter. It could result in jail time and loss of your livelihood if not defended properly.

Other Consequences of a Criminal Conviction

Your employer may be forced to terminate your employment if you are convicted of a crime. If your employment involves driving and your driver’s license is suspended or revoked after a DWI arrest or conviction, your employer may be forced to terminate your employment.

If your employment requires a security clearance a criminal conviction may require your employer to terminate your employment. Employers may not hire you if a criminal conviction is discovered during a background check.

Immigration Consequences

A criminal conviction can have a serious impact on your immigration status. If you are a permanent resident (Green Card holder) the government may try to remove/deport you from the U.S. or may stop you from becoming a U.S. citizen.

If you are attempting to obtain a legal immigration status or other benefits a criminal conviction may be a problem. Your criminal case must be handled carefully to avoid such problem if possible.

Thomas V. Sassone’s immigration law experience helps him counsel clients in criminal immigration matters — when an arrest may impact immigration status. Depending on the situation, there are many things that may be done to make an offense immigration neutral. For example, the charges may be dropped, changed to a lesser offense or a diversionary or alternative program may be obtained.
